1. Description of Services

KSP offers fitness coaching and training services including group classes, personal training, weightlifting coaching, youth athletics, nutrition consulting, and body composition scans at our facility located at 401 Industrial Suite 8, Goddard, Kansas 67052.

Class bookings, memberships, scheduling, and payment processing are handled through Wodify, a third-party gym management platform. When you use Wodify, you are also subject to Wodify's terms of service and privacy policy, which we encourage you to review.

2. Eligibility

You must be at least 18 years of age to use our website independently and to enter into a membership agreement with KSP. Individuals under 18 may participate in our Youth Athletics and other programs only with the written consent of a parent or legal guardian. A parent or legal guardian must complete all registration, sign all required waivers, and assume responsibility for the minor's participation.2. Eligibility

To book classes, manage memberships, or make payments, you may be required to create an account through Wodify. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information during registration and to update your information as needed.

KSP is not responsible for any issues arising from the Wodify platform, including but not limited to technical errors, payment processing failures, or data handling by Wodify. For Wodify-related concerns, you may need to contact Wodify directly or work with our staff for assistance.

4. Membership, Payments, and Cancellation

Membership terms, pricing, and payment schedules are established at the time of your enrollment and are managed through Wodify. By enrolling, you agree to the payment terms presented to you during signup.

If you wish to cancel or modify your membership, you must contact KSP directly. Specific cancellation policies, notice periods, and any applicable fees will be communicated to you at the time of enrollment. Refunds, if applicable, are provided at the sole discretion of KSP unless otherwise required by law.

5. Assumption of Risk and Liability Waiver

Participation in fitness training, CrossFit, weightlifting, and other physical activities involves inherent risks, including but not limited to muscle strains, sprains, fractures, joint injuries, cardiovascular events, and other physical injuries. By participating in any KSP program or using our facility, you acknowledge that you are voluntarily assuming these risks.

You agree that KSP, its owners, coaches, employees, and agents are not liable for any injuries, damages, or losses that may result from your participation in our programs or use of our facility, except to the extent caused by our gross negligence or willful misconduct. You may be required to sign a separate liability waiver and/or informed consent form before participating in any program.

You should consult with a physician before beginning any exercise program, especially if you have any pre-existing medical conditions, injuries, or health concerns.

6. Rules of Conduct

When using our website or participating in our programs, you agree to:

Follow all instructions and safety guidelines provided by KSP coaches and staff.

Treat other members, coaches, and staff with respect.

Not use our facilities or equipment in a manner that is unsafe, disruptive, or damaging.

Not attend classes or training sessions while under the influence of alcohol or drugs.

Inform coaching staff of any injuries, medical conditions, or physical limitations before participating in any session.

KSP reserves the right to refuse service, revoke memberships, or remove any individual from our facility for violations of these rules or for any conduct that we deem harmful, unsafe, or disruptive, at our sole discretion.

7. Intellectual Property

All content on the KSP website, including but not limited to text, images, graphics, logos, videos, and programming, is the property of Kansas Strength & Performance or its content providers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written permission.

8. User-Submitted Content

By submitting reviews, testimonials, photos, or other content to KSP (whether through our website, social media, or in person), you grant KSP a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and distribute that content for marketing and promotional purposes. You represent that any content you submit is your own original work and does not violate the rights of any third party.

Our website contains links to and integrations with third-party services, including Wodify, Google Analytics, and social media platforms. These third-party services have their own terms and privacy policies. KSP is not responsible for the content, availability, or practices of any third-party services.

KSP makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of any information on our website. KSP does not guarantee specific fitness results. Individual results from our programs vary based on many factors, including personal effort, consistency, health conditions, and adherence to coaching and nutritional guidance.

To the maximum extent permitted by Kansas law, KSP and its owners, coaches, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, participation in our programs, or any related matter. Our total liability for any claim related to our services shall not exceed the amount you paid to KSP in the three months preceding the event giving rise to the claim.
